California Tax Updates for 9/8

Update 1:

New figures that affect your 2021 California taxes have been released, adjusted for inflation. Tax rates and related items have been indexed to reflect an inflation rate of 4.4%, according to the CA Franchise Tax Board (FTB). As it did for 2020, the FTB also included adjustments for the standard deduction. For single or separate taxpayers the standard deduction for 2021 rises from $4,601 to $4,803. For all others it rises from $9,202 to $9,606. Personal and senior exemptions rise from $124 to $129. For a joint or surviving spouse it increases from $248 to $258. The dependent exemption credit rises from $383 to $400. Contact your Linkenheimer CPA with questions.

California Tax Updates for 9/1

Update 1:

San Francisco will impose an additional employer tax on certain businesses, effective in 2022. Businesses affected are those in which the highest-paid managerial employee earns more than 100 times the median compensation of its employees. The tax rate will increase for every additional 100 times that the CEO’s pay exceeds the median worker’s pay. The extra tax maxes out when the ratio of CEO pay to worker pay reaches 600 to 1. The maximum tax on payroll is 2.4% or a surcharge on the gross receipts tax of up to 0.6%. Businesses that are exempt from San Francisco’s gross receipts tax, due to small business status, are also exempt from the pay ratio tax. Contact your Linkenheimer CPA with questions.

Update 1:

Employers in California counties plagued by wildfires get payroll tax relief. The CA Employment Development Dept. (EDD) has announced tax relief for employers in Trinity, Tehama and Shasta Counties, directly affected by the McFarland, Monument and Dixie Fires. Those employers may request up to a 60-day extension of time from the EDD to file their state payroll reports and deposit payroll taxes, without penalty or interest. California Tax Updates from 8/20

Update 1:

Three southern California grocery stores will pay fines of $447,836, for violations of certain COVID-19-related employee benefits. The CA Labor Commissioner’s Office has cited three El Super stores for failing to inform employees of their rights to supplemental paid sick leave (SPSL). In addition, employees who had COVID-19 symptoms were forced to work while sick or were told to file for unemployment while under quarantine or isolation. Others waited months to be paid. The violations affected 95 El Super workers. Employers having more than 25 workers must provide those affected by COVID-19 with up two weeks of SPSL. This law remains in effect until Sept. 30, 2021.

California Pass-Through Entity Tax

Governor Gavin Newsom signed Assembly Bill 150 this past July. The new bill establishes an elective pass-through entity (PTE) tax framework that will allow California taxpayers to obtain relief from the current $10,000 limit on individual state and local tax deductions.

  • Qualifying pass-through entities include partnerships (publicly traded partnerships aren’t included) or S Corporations.
  • Qualifying entities must exclusively have partners/shareholders/members that are corporations, individuals, fiduciaries, estates, or trusts.
  • For tax years beginning on or after January 1, 2021 and before January 1, 2022
    • PTE tax is due on or before the filing date of the original return. (March 15, 2022 for 12/31/2021 year-end entities)
  • For tax years beginning on or after January 1, 2022 and before January 1, 2026
    • The greater of 50% of the elective tax paid in the prior year or $1,000 is due by June 15th of the tax year.
    • The remaining PTE tax is due on or before the filing due date of the original return.
  • The election must be made every year but once made, it is irrevocable.
  • The tax is 9.3% of qualified net income.
